القاهرة للتنمية والقانون تشيد بإحالة طبيب إلي لجنة الآداب: يروج للولادة القيصرية غير المبررة طبيًا.. وتطالب وزارة الصحة ونقابة الأطباء لوقف العنف ضد النساء وتعميم مدونة السلوك المهنى لمقدمي الخدمات الصحية.

تشيد مؤسسة القاهرة للتنمية والقانون بإحالة طبيب (م.د) الي لجنة الآداب بنقابة الأطباء المصرية، للتحقيق معه في الترويج للولادة القيصرية غير المبررة طبيًا، ومخالفته الصارخة لمواد عديدة بشأن لائحة أداب مهنة الطب ذكرها د.خالد امين عضو لجنة آداب المهنًة بنقابة أطباء مصر ، في تصريح علي صفحته الشخصية علي موقع التواصل الإجتماعي “فيسبوك”، وهي:

مادة (53) : يحظر على الطبيب إجراء أية تجارب للأدوية والتقنيات على الآدميين قبل إقرارها من الجهات المختصة.

مادة ( 3 ) :على الطبيب أن يكون قدوة حسنة في المجتمع بالالتزام بالمبادئ والمثل العليا، أميناً على حقوق المواطنين في الحصول على الرعاية الصحية الواجبة، منزهاً عن الاستغلال بجميع صوره لمرضاه أو زملائه أو تلاميذه.

وهي مواد صريحة طبقا للائحة أداب مهنة الطب تمنع ما ذكره الأطباء عن محتوى ما قدمه الطبيب وما ادعاه من اكتشاف طريقة جديدة و”تنفيذها” لعمل الولادة القيصرية بدون جرح وهو ما يعد تغريرا واستغلالاً للعديد من البسطاء او ادعاء طريقة جديدة في العلاج لم يتم الاتفاق والاستقرار عليها علمياً.

يذكر أن خلال الفترة الأخيرة، خاصة مع ارتفاع معدلات الولادة القيصرية في فى العالم وفي مصر خصوصًا، لتحتل مصر المرتبة الثالثة في العالم بإجراء هذا النوع من الولادة، وأصبحت الولادة القيصرية هي الأساس والولادة الطبيعية هي الاستثناء فقد أشار المسح السكانى الصحى 2021 إلى ارتفاع نسبة الولادات القيصرية، فـ72.7% من السيدات قد أنجبن طفلهن الأخير بولادة قيصرية، بارتفاع عما تم رصده في 2014 حيث كانت النسبة 51.8% من الولادات
والجدير بالذكر أن مؤسسة القاهرة للتنمية والقانون، قامت بإنتاج مدونة السلوك المهني لمقدمى الخدمات الصحية بشأن التعامل مع مع النساء وخاصةً الناجيات من العنف على جميع المراكز الطبية ، العيادات، والمستشفيات بالجمهورية من خلال وزارة الصحة المصرية.
والتى تنص في أحد بنودها على :
للنساء الحق فى الولادة الطبيعية الآمنة، دون فرض الولادة القيصرية عليهن إلا بعد موافقتهن في حالة الضرورة الطبية للأم أو الجنين، وذلك على ألا تزيد إجمالي الولادات القيصرية في أي منشأة صحية عن الحد المسموح به – كما حددته منظمة الصحة العالمية وهو 15% من إجمالي عمليات الولادة.

وتحتوي المدونة علي 3 فصول تشمل التعاريف، حقوق النساء اثناء تلقي الرعاية الطبية، سياسات واجراءات الشكاوي
والجدير بالذكر أن مؤسسة القاهرة للتنمية والقانون، تستقبل الشكاوى والطلبات والاستفسارات على الخط الساخن الخاص بالدعم القانوني للناجيات من العنف رقم 01210009192، وذلك لتقديم الاستشارات ، الدعم القانوني لهن إذا لزم الامر، وذلك يوميا من الساعة التاسعة صباحا وحتى الساعة الرابعة مساء.

وفي هذا الصدد تؤكد مؤسسة القاهرة للتنمية والقانون التزامها التام بالحفاظ على معايير السرية، الخصوصية اللازمة لقضايا الناجيات من العنف، وحرصها التام على حماية الناجيات من العنف من أي ضرر قد يلحق بهن جراء تعرضهن للعنف القائم على النوع الإجتماعي.

لذلك تطالب مبادرة مراكز رعاية طبية آمنة للنساء بما يلي:-

1-صدور القانون الموحد لتجريم العنف ضد النساء.

2- تعميم مدونة السلوك المهني لمقدمي الخدمات الصحية بشأن التعامل المهني اللازم مع النساء وخاصة الناجيات من العنف.

3-إنشاء مفوضية منع التمييز التي نص عليها الدستور المصري في المادة 53 لسنة 2014 من أجل ضمان تصدي أكثر للتمييز القائم على النوع الإجتماعي.

4- إدراج نصوص تراعى معايير النوع الإجتماعي في مشروع قانون المسئولية الطبية.

5-يجب توفير وضمان حماية الشهود والمبلغين قبل وأثناء وبعد التحقيقات.

Cairo Foundation for Development and Law praises the referral of a doctor to the Ethics
Committee: He promotes unjustified caesarean section… We call on the Ministry of Health and the Medical Syndicate to stop violence against women and dissemination of the Professional Health Code of Conduct for service providers

Cairo Foundation for Development and Law (CFDL) commends the referral of a physician (M.D) to the Ethics Committee of the Egyptian Medical Syndicate, to investigate him for a medically unjustified caesarean section, and his flagrant violation of many articles regarding the medical ethics regulations mentioned by Dr. Khaled Amin, a member of the Ethics Committee of the Egyptian Medical Syndicate, in a statement on his personal page on the social media website “Facebook”, i.e. article 53: A doctor is prohibited from conducting any experiments on drugs and technologies on humans before they are approved by the competent authorities and article (3): The doctor must set a good example in society by adhering to the principles and ideals, and is faithful to the rights of citizens to obtain due health care, free from all forms of exploitation of his patients, colleagues or students. These are explicit articles that prevent what the doctors mentioned about the content of what the doctor presented and what he claimed to discover a new method and (implement it) to perform a cesarean section without wounding, which is considered deception and exploitation for many simple people or claiming a new method of treatment that has not been agreed upon and established scientifically.

It is worth mentioning that during the recent period, especially with the high rates of cesarean delivery in the world and in Egypt in particular, Egypt came in third grade in the world in conducting this type of childbirth, and cesarean section became the basis and natural childbirth is the exception.

The Demographic Health Survey in 2021 indicated an increase in the rate of cesarean deliveries, as 72.7% of women had given birth to their last child by cesarean section, an increase from what was monitored in 2014, when the rate was 51.8% of births. CFDL calls for the need to circulate the professional code of conduct for health service providers regarding dealing with women, especially survivors of violence, in all medical centers, clinics, and hospitals in all over Egypt through the Egyptian Ministry of Health.

In this regard, CFDL affirms its full commitment to maintaining the standards of confidentiality and privacy necessary for the cases of survivors of violence, and its full keenness to protect survivors of violence from any harm that may befall them as a result of their exposure to gender-based violence.

Therefore, the Safe Medical Care Centers for Women initiative calls for the following:
1- Issuance of the unified law to criminalize violence against women.
2- Disseminate a code of professional conduct for health service providers regarding the necessary professional dealings with women, especially survivors of violence.
3- The establishment of the Commission for the Prevention of Discrimination, which was stated in the Egyptian constitution of 2014 in article 53, in order to ensure a greater response to discrimination based on gender.
4- Inclusion of provisions that take into account gender standards in the medical liability draft law.
5- The protection of witnesses and reporters must be provided and guaranteed before, during and after investigations.
